High Court Suspends Finance Act 2023

The High Court in Kenya has suspended the Finance bill/act 2023. The Finance bill that was to take effect is now suffering a blow after the court rule in favour of Busia Senator Okiya Omutata.

This happens after Sen. Omutata moved to court tabling a challenge to the implementation of the Finance Bill 2023.

The ruling was served by Lady Justice Mugure Tande who placed a pause to the implementation of the act which could take effect on 1st July 2023.

“i am satisfied that the application meets the test for conservatory orders, and i do grant prayers 2 and 3 of the application until 5th July 2023 when the matter is scheduled for mention for directions,” He ruled.

According to Omutata, the Finance Bill has amendments that affect the work of the senate.

Omutata now urges the Senate to reverse some sections in the Kenya Kwanza Bill 2023.

Omutata says the National Assembly violated the constitution by introducing the Finance Bill 2023 in the National Assembly without first being determined by combination of the two speakers anf finding out if it affects the county government.
